HOADLEY V. JENKINS

Mr Beasley was council for the plaintiff; and Mr Joyce and Mr. Rigby for the defendant.
The action was brought by the plaintiff, a coachbuilder at Kensington, to recover 76l. 12s. for a waggonette and repairs thereto. The defendant pleaded his discharge under a composition deed. The plaintiff had refused to assent to the deed, but the requisite majority of creditors has assented to a composition of 2s. 6d. in the pound, and the only question in this case was whether the amount the plaintiff was entitled to had been tendered to him or to a person authorised by him to receive it. The tender, in point of fact, was made to the plaintiff's nephew, who was in his employ as a coach painter, but had no authority to cast in this matter. The nephew refused to take the money, and it was not left.
The jury returned a verdict for the plaintiff, finding that the nephew was not authorised to accept the tender.

THIS IS THE LAST WILL AND TESTAMENT of me Alexander Hoadly of no. 21 Pier Road Rosherville Northfleet Kent Gentleman.
1. I appoint my nephew Alexander Hoadly and my friend [?] Haynes of Maidstone Kent Ironmonger my Executors and declare that the term "my Trustees" hereinafter used shall include my said Executors and the survivor of them and the executors or administrators of such survivor their or his assigns or other the trustees or trustee for the time being of this my Will.
2. I give all my real and personal estate to my trustees upon trust as soon after my decease as conveniently may be to convert the same into money with all the powers of absolute owners and to stand possessed of the net proceeds to arise therefrom and my ready money and thereout pay my just debts funeral and testamentary expenses and invest the balance of such net proceeds on authorised securities.
3. Upon trust to pay the Annual product and income arising therefrom into the proper hands of my daughter Elizabeth Catherine Gray for and during her life for her sole and separate use and so that my said daughter may not have power to alienate dispose of or receive the same or any part thereof in the way of anticipation.
4. And from and after the decease of my said daughter upon trust to realise the said investments and to pay and divide the net proceeds of such realisation unto and equally between all the children of my said daughter living at my decease and the issue per [stripes?] attaining twenty one of such one or more of them as may predecease me such issue taking the share only to which their part would have entitled if living.
5. Notwithstanding the direction aforesaid I empower my trustees in their discretion to continue in their then state of investments at my decease without being responsible for any loss, which may happen thereby.
6. I revoke all former wills in witness whereof I have hereunto set my hand this seventh day of August one thousand eight hundred and ninety - Alex. Hoadly -

"Alexander Hoadly, son of William Hoadly of Maidstone in the County of Kent, Coachmaker, of his own free will and accord doth put himself apprentice to the said William Hoadly his father to serve from the day of the date of the indenture for the term of seven years to learn the art of a Coachmaker. Indenture dated 3 January 1821.Enrolled Maidstone 19 March 1821""Maidstone Burghmote held the 14th day of July 1830 before Robert Tapsell, Esquire, Mayor ...At this court also came Alexander Hoadly, having served his apprenticeship with William Hoadly of this Town, Coachmaker, a Freeman of this Corporation and desired to be made free, and he is allowed the same and hath paid his common fine twelve pence and hath taken his Freeman's oath and the other oaths and he is made free."

In 1881 Alexander was a boarder with Charles Carpenter at Huntley House, in Western Road, Bishopsteignton in Devon. This appears to have been a Health resort. It seems at this period of his life, he was retired and enjoying travelling. [RG11/2158/9/11]
